Sumario:The present article aims to share some reflections and questions that arose from the professional practices of the fifth year of the degree in Social Work carried out in the Provincial Public Service of Criminal Defense during the year 019. For the pose of this writing we take as reference five cases of young men, whose ages range between 18 and 25 years, charged with crimes of low criminal scale, who have served or are being held in preventive detention in maximum security penitentiary units (N° 1 in Coronda and N° 11 in Piñero) of the province of Santa Fe. The main objective is to outline some preliminary analyses about how the social condition of being subjects categorized “in street situation” may constitute a critical factor to go through the instance of investigation in the criminal process while imprisoned. It may seem as if the fact of not counting with a domicile is interpreted as lack of rooting and, as a consequence, both are presumed as a danger of escaping or hindering the investigation. Considering what has been evaluated in our practical experiences, we can state that the principles that rule the applications of preventive detention are affected by the criminal process of young people, in such a way that the restriction of ambulatory freedom becomes excessive. In these cases, from the perspective of Social Work we came up with intervention strategies, within the framework of proposals for releases or alternative measures, recovering the stories and life trajectories of the young to guarantee the access to rights and social policies.
