In late 1956, metalworkers staged a strike for better wages and working conditions. The paralysis of activities in one of the most important branches of economic activity occurred within the framework of the dictatorship that had overthrown Perón the previous year. The military authorities, through the Ministry of Labour, used a resolution of the Peronist government to quickly declare the strike illegal. Once the conflict was resolved, workers dismissed during the conflict and were not reinstated decided to seek justice in the Labour Courts.
Based on the analysis of files from the Quilmes jurisdiction, the hypothesis will be proposed that labour justice acquired, in a repressive context and clearly of retroversion of workers' rights, the character of containment against the advance of the state and employers. It is within this context that the right to strike was contested in courts by the workers themselves. At the same time, it allows us to reflect on the scope of the repressive reformulation of the labour world carried out by the Libertadora and the impact of union reorganization on the forms of conflict. |

A fines de 1956 los trabajadores metalúrgicos llevaron adelante una huelga por salarios y condiciones de trabajo. La paralización de las actividades de una de las ramas más importante de la actividad económica se dio en el marco de la dictadura que había derrocado a Perón el año anterior. Las autoridades militares a través del Ministerio de Trabajo resolvieron utilizar una resolución del gobierno peronista para declarar rápidamente el carácter ilegal de la medida de fuerza. Resuelto el conflicto trabajadores despedidos en el marco del conflicto y que no fueron reincorporados decidieron acudir a los Tribunales del Trabajo a fin de obtener justicia. A partir del análisis de expedientes de la jurisdicción de Quilmes se propondrá la hipótesis que la justicia del trabajo adquirió en un contexto represivo y claramente de retroversión de derechos obreros el carácter de contención ante el avance estatal y patronal. Es en este marco que el derecho a huelga fue disputado en los tribunales por los propios trabajadores. Al mismo tiempo permite reflexionar sobre los alcances de la reformulación del mundo laboral en clave represiva que llevó adelante la Libertadora y el impacto de la reorganización sindical en las formas del conflicto. No final de 1956, os metalúrgicos realizaram uma greve por melhores salários e condições de trabalho. A paralisação num dos setores mais importantes da economia ocorreu no contexto da ditadura que tinha derrubado Perón no ano anterior. As autoridades militares, através do Ministério do Trabalho, utilizaram uma resolução do governo peronista para declarar a greve ilegal rapidamente. Uma vez resolvido o conflito, os trabalhadores que tinham sido despedidos durante a greve e não foram reintegrados decidiram procurar justiça nos Tribunais de Trabalho. Com base na análise de processos da jurisdição de Quilmes, este artigo propõe a hipótese de que, num contexto repressivo marcado pela clara erosão dos direitos dos trabalhadores, os tribunais do trabalho adquiriram o papel de travão ao avanço do Estado e dos empregadores. É neste contexto que o direito à greve foi contestado judicialmente pelos próprios trabalhadores. Ao mesmo tempo, permite refletir sobre o alcance da reformulação repressiva do mundo do trabalho levada a cabo pela Libertadora e o impacto da reorganização sindical nas formas de conflito.
