Based on this theoretical dispute, the necessity of analyzing the legality or illegality of abortion within the provisions of Athenian Law is concluded. A strict examination of lexical elements in the two fragments that constitute Lysias' speech X (Gernet's edition), which stands as the only legal remain on the apparent criminalization of ἄμβλωσις, allows us to suggest a number of inferences on the judicial interpretation of the facts alleged and on the characteristics of its treatment within court proceedings in the late Vth and early IVth Century. Nuestro estudio parte de las contradicciones en las evidencias sobre la utilización de prácticas abortivas en la sociedad griega clásica, transmitidas tanto a través de testimonios médicos (como el corpus hippocraticum) cuanto filosóficos (Platón, Aristóteles). En virtud de esta polémica teórica, se plantea la necesidad de analizar la legalidad o ilegalidad del aborto en el marco estricto del derecho ateniense. El examen minucioso de la terminología empleada en los dos pasajes preservados del discurso 10 de Lisias (Gernet), único testimonio judicial sobre la aparente penalización en materia de ἄμβλωσις, permite plantear ciertas inferencias acerca de la interpretación judicial del hecho y las características de su tratamiento jurídico en los procesos a fines del siglo v a.C. y principios del s. IV.
