| Sumario: | This paper seeks to analyze how the effects of a declaratory judgment on constitutionality spread in two systems of diffuse constitutionality control\nwith inter partes effects ?that of the United States and Argentina. Certain significant differences are highlighted, and the conclusion is that although the general rule under the Argentine constitutional system is that the judgment on constitutionality is only effective inter partes, there is a direct spread of the effects of decisions entered in proceedings relative to collective rights. That is why it does not differ much from the American system, where this spread is also produced by judgments entered in class actions. In Argentina, as opposed to the United States, there is no indirect spread of the effects of Supreme Court rulings because the vertical stare decisis doctrine is not in force |
