| Sumario: | This paper aims to make an analysis regarding the considerations made by the Inter-American Court of Human Rights and the European Court of Human Rights regarding the phenomenon of trafficking in persons for the purpose of exploitation and their connection with that central sphere of rights that make up jus cogens. Also, the implications that this has in the treatment of cases and in the protective standards of both regional systems (Latin American and European) for the States parties will be analyzed. From the examination of the arguments made when solving the cases submitted to their study we will attempt to deduce limits and advances in the construction of these protective standards, both in criminal and human rights matters. |
