| Sumario: | This article has the aim of analyzing the performance of the Interamerican Court on Human Rights in the protection of economic, social, cultural and environmental rights. In particular, it will revise the evolution of its contentious jurisprudence in this field. For that, different phases in this path towards direct justiciability will be identified and examined: from the case "Lagos del Campo c. Perú" to "Comunidades Indígenas miembros de la Asociación Lhaka Honhat (Nuestra Tierra) vs. Argentina". In these cases, the Court in a change of direction regarding its previous case law, declared the autonomous violation of article 26 of the American Convention on Human Rights. At the same time, we will assess the normative challenges of this evolution as well as factual and political challenges related to the economic and social situation of the American continent. We hope this turning point will improve access for victims, particularly in Latin America, to fundamental social rights that are a precondition of an autonomous life in freedom, dignity and equality. |
