Sumario:This research aims to reflect on the legal value of jus cogens norms, their consequences, and their role in international disputes. To this end, it analyses the types of norms in public international law, the different theoretical frameworks on which the existence of jus cogens norms can be based and the consequences of the violation of such norms. Two case studies are also taken, one concerning jurisdictional immunity and the other concerning the jurisdiction of the International Court of Justice, in order to see how the respective judges have dealt with the invocation of jus cogens norms in international disputes. All of this leads us to conclude that jus cogens norms or peremptory norms of international law have hierarchy over operative norms, but, despite this, the International Court of Justice has had operative norms applied over the violation of jus cogens norms invoked in the dispute
