However, there is no agreement between legal scholars as to what is involved in that activity. There is one aspect, however, in which good part of different theories seem to coincide, to wit, that courts adjudicating cases must provide justificatory reasons for their decisions. In court rulings, the reasons that support decisions are of central importance. As our institutions are designed, we not only ask courts to decide our legal disputes, but we also require them to do so in a justified (motivated) way. But which are the legally relevant reasons in ​​judicial adjudication? In what follows, we advance some conceptual distinctions for the analysis of these reasons. In doing so, we will focus on the challenges posed by legal interpretation. Our aim is to propose a set of tools that can serve in the evaluation of the normative premises of legal arguments, and, within them, the ones made by courts. Un modo de entender la tarea de la magistratura es como encargada de determinar los derechos y deberes jurídicos impuestos por el ordenamiento. Sin embargo, en qué consista esa actividad no posee una respuesta pacífica entre quienes hacen filosofía y teoría del derecho. Hay un aspecto, sin embargo, en el cual parece coincidir buena parte de las diferentes teorías, y es que la magistratura, en su tarea de adjudicar casos, tiene que ofrecer razones justificatorias de sus decisiones. En las sentencias judiciales las razones que dan sustento a las decisiones tienen una importancia central. Tal como están diseñadas nuestras instituciones, no solo les pedimos a las cortes que resuelvan nuestras disputas jurídicas, sino que también les exigimos que lo hagan de una manera justificada (motivada). Pero, ¿cuáles son estas razones jurídicamente relevantes en el ámbito de la adjudicación judicial? En lo que sigue, nos proponemos dejar planteadas algunas distinciones conceptuales para el análisis de estas razones. En tal tarea, nos centraremos en los desafíos que plantea la interpretación jurídica. Nuestro objetivo es proponer un conjunto de herramientas que puedan servir en la evaluación de las premisas normativas de los argumentos jurídicos, y, dentro de ellos, los judiciales.
