The issue is approached from the models of disability in relation to the international and national normative system for the protection of the rights of people with disabilities. In the judicial sentence the review is framed as a right-duty and -of divided vote- the tension between two models of disability and their consequences is evidenced, covering the influence that these conceptions have on the construction and normative interpretation. El fallo que se analiza trata sobre la declaración de inaplicabilidad del derecho de revisión de la sentencia declaratoria de incapacidad. Se aborda el tema desde los modelos de la discapacidad en relación al sistema normativo internacional y nacional de protección de derechos de las personas con discapacidad. En el fallo se encuadra a la revisión como un derecho-deber y -del voto dividido- se evidencia la tensión entre dos modelos de discapacidad y sus consecuencias, recorriendo la influencia que tienen dichas concepciones en la construcción e interpretación normativa.
