Although thisprocess can be dismembered for study, and for the correct performance at each stage, it should not be when the purpose is to establish the responsibility of the notary public for the damage produced. In the notary there is a trust imposed by the work he performs. The duty not to harm makes him objectively responsible to the requesting party as well as to third parties. Resumen: La responsabilidad notarial debe ser analizada entendiendo su función como un “proceso”, que comprende etapas en las que se desarrollan técnicas documentales y de ejercicio, que permiten llegar a un resultado, esto es la autorización de un instrumento válido, veraz, oponible y que hace fe por sí mismo. Si bien este proceso puede ser desmembrado para su estudio, y para la correcta actuación en cada etapa, no debe serlo cuando el fin sea establecer la responsabilidad que le cabe al escribano ante el daño producido. En el escribano existe una confianza impuesta por la labor que desempeña. El deber de no dañar lo hace responsable objetivamente frente a su requirente como frente a terceros.
