The development of clear and simple nutrition labeling, such as front-of-package labeling, is a useful tool to promote further well-informed consumer decisions. Yet, attempts to move forward with national public policies in this subject are often deterred due to front packaging labelling not being explicitly mentioned in nutrition labelling Codex Alimentarius regulation standards, which currently serves as the only framework proposed in this area. This work is particularly aimed at analyzing how front-of-package labeling omission in the Codex’s rules affects processes carried out in States that intend to implement this policy and, on this basis, to reflect on to what extent the Codex’s normative has the capacity to meet a growing need for food regulation in order to limit the impact of obesity. In order to do so, a normative analysis will be carried out: Codex regulatory documents on nutrition labeling will be reviewed, in line with The Technical Barriers to Trade Agreement; recommendations of relevant institutions in this field such as WHO and PAHO will also be revised; and, last, the Chilean experience front-of-package labeling implementation will be mentioned in order to illustrate obstacles that need to be addressed whenever a State intends this regulation’s implementation.

El sobrepeso y la obesidad constituyen un problema de salud pública de gran magnitud y, cada vez más, se incrementa su prevalencia tanto en países desarrollados como en vías de desarrollo. Esta problemática tiene como una de sus principales causas al aumento en la ingesta de alimentos altos en calorías, grasas, sal y azúcares; preferencia que se vincula fuertemente con las estrategias de marketing y publicidad desarrolladas por la industria alimenticia. El desarrollo de un etiquetado nutricional efectivo, como el etiquetado frontal, se podría constituir como una herramienta útil a partir de la cual el consumidor adoptara decisiones de consumo más informadas. Sin embargo, los intentos de avanzar en  políticas públicas nacionales se encuentran obstaculizados por la falta de adecuación con la normativa del Codex Alimentarius, que es planteado como el único marco de referencia en este ámbito. Los objetivos del presente trabajo son: analizar la adecuación del Codex para responder a las crecientes necesidades de regulación de los productos alimenticios para limitar el impacto de la obesidad y explorar otros marcos de referencia para estos avances. Para ello, se efectuará un análisis normativo: se revisarán las normas del Codex dirigidas a regular el rotulado de alimentos, en vinculación con el Acuerdo sobre Obstáculos Técnicos al Comercio; se analizarán también, las recomendaciones de instituciones relevantes tales como la OMS y la OPS; y se valorará la experiencia chilena en la implementación del etiquetado frontal.  A partir de ello, se podrán establecer las relaciones entre las distintas normas que regulan el rotulado de alimentos y el comercio internacional; identificar contradicciones, vacíos e inconsistencias; y advertir mejores prácticas y áreas de oportunidad para el posterior impulso de estrategias en salud pública.
