description Since the 1980s, Argentine exiles have been engaged in the fight for justice for the victims of the dictatorship the settled in the country in 1976; however, their participation in the process initiated by Alfonsín in 1983 was small due to the way it was conducted. Only in the second half of the 1990s, with the opening of a criminal case against the Argentine military in Spain, exiles who had remained in the country found space to integrate al lead the fight for justice and reparation for the victims. Based on the perspectives defended by some of the legal protagonists in the process, we analyzed how the opening of a case for genocide and terrorism in one of the main host countries of exile gave to Argentines the possibility of fighting so that the repressors don’t go unpunished, resuming the transitional justice process.

Desde los años ochenta, los exiliados argentinos se han dedicado a la lucha por la justicia para las víctimas de la dictadura que se instaló en el país en 1976, sin embargo, su participación en el proceso iniciado por Alfonsín en 1983 se ha visto disminuida por la forma en que se llevó a cabo. Sólo en la segunda mitad de los años noventa, con la apertura de una causa penal a los militares argentinos en España, los exiliados que habían permanecido en ese país encontraron espacio para integrarse y liderar la lucha por la justicia y la reparación a las víctimas. Desde las perspectivas defendidas por algunos de los protagonistas jurídicos de este proceso, analizamos cómo la apertura de una causa por genocidio y terrorismo en uno de los principales países del exilio dio a los argentinos exiliados la posibilidad de luchar para que los represores no quedaran impunes, reanudando el proceso de justicia transicional.   Desde os anos 1980 exilados argentinos se engajaram na luta por justiça para as vítimas da ditadura que se instalara no país em 1976, contudo, sua participação no processo iniciado por Alfonsín em 1983 acabou sendo diminuída devido a maneira como esse foi conduzido. Somente na segunda metade da década de 1990, com a abertura de uma causa penal aos militares argentinos na Espanha, exilados que haviam permanecido naquele país encontraram espaço para integrar e protagonizar a luta por justiça e reparação às vítimas. A partir das perspectivas defendidas por alguns dos protagonistas jurídicos desse processo, analisamos como a abertura de uma causa por genocídio e terrorismo em um dos principais países de acolhida do exílio deu aos desterrados argentinos a possibilidade de lutar para que os repressores não ficassem impunes, retomando o processo de justiça transicional.
