But the momentum of this new model is not without its difficulties. In this essay, we postulate some challenges directly or indirectly related to intellectual property that either generates significant resistance to the adoption of the Open Science model or does not yet have a satisfactory response within the current Open Science recommendations. We specifically explore three issues: 1) the intellectual property barriers to legal access to data as input in the framework of data science-based research, 2) the difficulties in protecting the public domain or intellectual creation as a common good, and 3) the absence of appropriate standards or mechanisms to claim the ethical reuse of open scientific production. This is an exploration from a critical point of view in which we leave several questions open with the aim of contributing to the debate by the scientific community.

La difusión del modelo de la Ciencia Abierta con el fin de eliminar las brechas de conocimiento es una necesidad cada vez más acuciante y la experiencia vivida durante la pandemia de COVID19 es prueba de ello. Pero el impulso de este nuevo modelo no está exento de dificultades. En este ensayo postulamos algunos desafíos relacionados directa o indirectamente con propiedad intelectual que, o bien generan importantes resistencias para la adopción del modelo de la Ciencia Abierta, o aún no cuentan con una respuesta satisfactoria dentro de las actuales recomendaciones de Ciencia Abierta. Exploramos específicamente tres temas: 1) las barreras de propiedad intelectual para el acceso legal a los datos como insumo en el marco de la investigación basada en ciencia de datos, 2) las dificultades para proteger el dominio público o la creación intelectual como bien común y 3) la ausencia de estándares o mecanismos apropiados para reclamar el reúso ético de la producción científica abierta. Se trata de una exploración desde una mirada crítica en la que dejamos varias preguntas abiertas con el objetivo de aportar al debate por parte de la comunidad científica. A disseminação do modelo de Ciência Aberta para colmatar as lacunas de conhecimento é uma necessidade cada vez mais premente e a experiência durante a pandemia de COVID-19 é prova disso. Mas o impulso deste novo modelo não está isento de dificuldades. Neste ensaio, postulamos alguns desafios directa ou indirectamente relacionados com a propriedade intelectual que ou geram uma resistência significativa à adopção do modelo de Ciência Aberta, ou ainda não são abordados de forma satisfatória nas actuais recomendações da Ciência Aberta. Exploramos especificamente três questões: 1) barreiras de propriedade intelectual ao acesso legal a dados como contributo para a investigação baseada na ciência dos dados, 2) dificuldades na protecção do domínio público ou da criação intelectual como um bem comum, e 3) ausência de normas ou mecanismos adequados para reivindicar a reutilização ética da produção científica aberta. Esta é uma exploração crítica em que deixamos várias questões em aberto com o objectivo de contribuir para o debate na comunidade científica.
