We will see that not a few of those who repudiate Carl Schmitt for his collaboration with National Socialism share not only his theory of law at the time, but particularly his defence of a conception of the rule of law that violates the fundamental rights of defendants. At the same time, these considerations will help us understand that the debate on the rule of law is more alive than ever.   Este trabajo estudia la discusión nacionalsocialista sobre el Estado de derecho usando como caso testigo la obra de Carl Schmitt correspondiente al período entre 1934 y 1936. De esta forma veremos que no pocos de los que repudian a Carl Schmitt por su colaboración con el nacionalsocialismo comparten no sólo su teoría del derecho en esa época, sino particularmente su defensa de un Estado del derecho que viola los derechos fundamentales de los acusados. A la vez, estas consideraciones nos permitirán apreciar que el debate sobre el Estado de derecho está más vivo que nunca. Este trabalho estuda a discussão nacional-socialista sobre o Estado de Direito usando como caso testemunha o trabalho de Carl Schmitt correspondente ao período entre 1934 e 1936. Desta forma veremos que não são poucos aqueles que repudiam Carl Schmitt por sua colaboração com o Nacional-Socialismo não partilham não só a sua teoria do direito da época, mas particularmente a sua defesa de um Estado de direito que viola os direitos fundamentais dos acusados. Ao mesmo tempo, estas considerações permitir-nos-ão compreender que o debate sobre o Estado de direito está mais vivo do que nunca.
