The clauses comprising the collective bargaining agreement are normative, obligatory, and other types. The legal nature of the collective bargaining agreement is dual (it contains a contractual component and another component with rules that apply as objective law). While the traditional concept of a collective bargaining agreement applies only to dependent workers, new forms of work organization have led to an adjustment of the concept to include self-employed workers and workers in intermediate categories. El convenio colectivo es una figura particular del derecho colectivo del trabajo que reúne las características de un contrato, pero con efectos obligatorios para terceros (fuente de derecho). Los elementos del concepto son: un acuerdo de voluntades, entre sujetos particulares (representantes de trabajadores y empleadores), para fijar condiciones de trabajo. Las cláusulas que integran el convenio colectivo son normativas, obligacionales y de otro tipo. La naturaleza jurídica del convenio colectivo es dual (contiene una parte contractual y otra con reglas que se aplican como derecho objetivo).
