In the frame of rulings related to Human Rights issues, Judges do debate on the relationship between Law and State, they nevertheless also seem to accept the fact that judicial decision is the product of a mechanical application of legal norms, thus, denying their own subjectivity -an attitude that reflects the specificity of legal ideology. Nos interesa seguir el punto de vista del juez y el del ex secretario del juzgado, autores del texto. El formalismo como tipo ideal se vuelve un instrumento analítico para explicar la especificidad del razonamiento de los jueces.
