| Sumario: | In this paper, we will analyze a judicial ruling which is part of a Human Rights case. We are interested in the judge's and the clerck's viewpoints - the authors of the ruling. Formalism as an "ideal type" will be here used as an analytical instrument, a way of explaining the specificity of judicial reasoning. In the frame of rulings related to Human Rights issues, Judges do debate on the relationship between Law and State, they nevertheless also seem to accept the fact that judicial decision is the product of a mechanical application of legal norms, thus, denying their own subjectivity -an attitude that reflects the specificity of legal ideology. |
