After choosing one, the candidate prepared a written account for reflection and subsequent presentation. Needless to say, the oral examination was not read aloud. Today, its publication has been deemed worthwhile; some reformulated statements are included, thanks to the revisions facilitated by the objections and/or questions of the jury members. The jury established approximately 20 topics. The one chosen by the author was: Among the constitutional guarantees of a structural nature (separation of powers, checks and balances, federalism, etc.) and the constitutional guarantees of individual rights: which do you consider to be the most important for the defense of liberty? The citations of authors are presented as they were introduced in the oral presentation; now, they are only noted in footnotes, and at the end of the work, in section § VI, Sources, the work and the page numbers where the citation appears are listed in greater detail. The statement, declaration, or concept of the cited author, or of those not cited but consulted, is included. This does not alter the usual method of recording bibliographic references. It simply maintains fidelity to the structure of the oral presentation. Section VII also includes: a) the research guidelines and course direction, and b) the teaching programs, as presented to the Jury.."

El jurado integrado por los Profesores Doctores Luis Aguiar de Luque, Antonio Torres del Moral y Robert Barker distinguió al autor en el primer lugar en de la valoración global de los méritos antecedentes, prueba de oposición y entrevista personal y por ende lo propuso para ocupar la plaza del concurso. Aunque es una práctica en otros lugares del Mundo, por los rasgos inherentes de los concursos en la UBA, no se publican los textos de las oposiciones orales por diferentes motivos, uno de los ellos, quizás el principal, que las disertaciones orales no son recogidas en soporte papel, grabación o video. En este caso la producción escrita precedió a la oral; dicho con más claridad todavía: publicados los temas por indicación de los miembros del jurado internacional noviembre de 2008, el aspirante luego de elegir uno de ellos dispuso su meditación y ulterior exposición escrita. Huelga decirlo: el examen oral no fue leído. Hoy se ha juzgado interesante su publicación; se incluyen algunas afirmaciones reformuladas, merced a la reelaboración facilitada por las objeciones y/o preguntas de los señores miembros del jurado. El jurado fijó cerca de 20 temas. El elegido por el autor fue: Entre las garantías constitucionales de naturaleza estructural (separación de poderes, checks and balances [pesos y contrapesos], federalismo, etc.) y las garantías constitucionales de derechos individuales: ¿cuáles considera usted que son las más importantes para la defensa de la libertad? .Las citas de autores se consignan tal como fueron introducidas en la disertación oral; ahora, únicamente, a pie de página se deja constancia y al final del trabajo en la sección § VI, Fuentes, se consignan con mayor extensión la obra y los números de páginas en las que consta el planteo, declaración o concepto del autor citado, o de los que no han sido citados pero fueron objeto de consulta. De esta forma no se decide alterar el modo habitual de constancia de las referencias bibliográficas. Simplemente, mantener fidelidad con la estructura de la disertación oral.
