The first section will present a genealogic approach to the Gender Identity Act by underlining various court scenes, which were chosen on a chronological basis and which are subject to an addition and subtraction game that operates on the free expression of. Each scene will be presented through critical lenses, with the purpose of envisaging the form, mechanisms and premises underlying the Gender Identity Act, conceived as a category within the "subject of rights" concept. Additionally, the piece will highlight who were the parties authorized to speak during court rituals, and which relationships were established in the construction of new subjectivities, following the hypothesis according to which the biomedical model of psychiatric-diagnosis -in the context of a power agreement with the judicial branch- coined normative definitions of sexual differences; texts and contexts in which voices overlapped with knowledge-power relationships within the legal discipline. The second part will propose how to interpret and apply the law with a rights-based approach (from a global south perspective). Gómez. -- Resumen: El presente artículo, parte de mi tesis de maestría, tiene tres partes. La primera indagará en una aproximación genealógica del DIG a partir del señalamiento de distintas escenas de la vida judicial, que fueron escogidas siguiendo un orden cronológico y de acuerdo con el juego de sustracción y adición operado sobre la libre expresión de género. Cada escena será expuesta a una mirada crítica a fin de vislumbrar de qué forma, con qué mecanismos y con cuáles premisas el DIG se configuró como categoría integrativa de la noción de sujeto de derecho. Además, se señalará quiénes eran los autorizados para hablar en los rituales judiciales, y las relaciones que se establecían en la construcción de nuevas subjetividades, siguiendo la hipótesis según la cual el modelo biomédico de diagnóstico psiquiátrico en pacto de poder con la justicia acuñó definiciones normativas de la diferencia sexual; los textos y contextos en que las voces se solapaban con las relaciones saber/poder dentro del entorno disciplinario del derecho. La segunda parte, aportará -desde una mirada del sur global- maneras de interpretar y aplicar la ley con un enfoque de derechos.
