Real actions are legal remedies of great importance for purposes of defending proprietary rights, where tracing claims prove to be vital because holders of any such actions are entitled to recover the thing subject matter of a property right in cases of a serious harm suffered by the holder, namely where dispossession of the object occurs. This paper deals with the legal scope of real actions, the nature of the harm entitling the holder to institute tracing claims and their procedural effects in the Argentine legal system provided by the Civil and Commercial Code. The generic and specific standing of holders of tracing actions, together with the eligibility of persons capable of being sued, is also studied throughout this work. The paper also analyses the procedural object of tracing claims and the rules governing proof in the procedure. Buenos Aires, Argentina Argentina Pepe, Marcelo Pérez Pejcic, Gonzalo 2022 Las acciones reales constituyen remedios procesales de gran importancia para la defensa de los derechos reales, dentro los cuales la acción reivindicatoria asume vital trascendencia, pues faculta al legitimado a recuperar la cosa objeto del derecho real en caso de una lesión de gravedad tal como la desposesión. En el presente trabajo se estudian el ámbito de las acciones en el Código Civil y Comercial de la Nación, su naturaleza, efectos y lesiones que las habilitan. Luego se analiza en particular la legitimación activa genérica y especifica en el proceso de reivindicación y los legitimados pasivos de la acción.
