Precedido por un breve estudio introductorio de los antecedentes británicos, el trabajo contiene un relevamiento de las fuentes constitucionales, legislativas, jurisprudenciales y doctrinarias tanto norteamericanas como argentinas que se pronunciaron sobre el tema en la época de sanción de la Constitución y durante las primeras décadas posteriores, con el objeto de ofrecer una perspectiva histórica que, como herramienta analítica, contribuya a comprender y contrastar la reconfiguración del rol institucional experimentado por el máximo tribunal entre los tiempos actuales y la época de su creación. El documento incluye también un estudio detenido de los debates en torno a la Corte Suprema y la judicial review que tuvieron lugar en el seno de la Convención de Filadelfia de 1787, poco explorados en nuestro país. The present paper intends to investigate how the constitutional function of the Supreme Court was thought at the time of its creation. Preceded by a brief introductory study of the British background, the work contains a survey of the United States and Argentine constitutional, legislative, jurisprudential and doctrinal sources that pronounced themselves on the subject at the time of sanction of the Constitution and during the first decades thereafter, in order to offer a historical perspective that, as an analytical tool, contributes to understand and contrast the reconfiguration of the institutional role experienced by the Supreme Court between the present times and the time of its creation. The document also includes a detailed study of the debates around the Supreme Court and judicial review that took place within the Philadelphia Convention of 1787, little explored in our country.
